With the recent changes made by Australia Post to their delivery methods and timeframes, many contracts containing notice provisions will need to be updated to reflect this change. A standard notice provision in many contracts will specify that if a notice is sent via post, it is assumed (under the contract) that they receiving party receives that notice the next business day. However, under the changes made by Australia Post, only notices made by Express Post are guaranteed next day delivery. If a notice is sent via "regular" mail (don't forget that stamps are now $1) then it may not be received by the receiving party for a week! This can have implications, especially where parties are in dispute and looking to terminate the contractual relationship.
